Despite the fact that Delaware is the most corporate-business friendly state in the union, a veritable a “flood of asbestos lawsuits” in Delaware courts starting in 2005, 80% of which were on behalf of out-of-state plaintiffs by an out-of-state mesothelioma lawyer.

As one of the oldest court systems in the nation, Delaware has no less than 101 chapters covering its legal code. One of these chapters is dedicated specifically to asbestos issues, which contains the most specific regulations of any state. According to Chapter 78, Section 1:“The Delaware General Assembly hereby declares that it is in the interest of the public to control, reduce and prevent the exposure of the public to asbestos. It is the intent of the General Assembly to ensure the health, safety and welfare of the public by regulating the practice of asbestos abatement, particularly in locations where the general public can reasonably be expected to have access for the purpose of ensuring that such abatement is performed in such a manner as to minimize exposure to asbestos fibers and contamination.”

Delaware is home to several oil refineries as well as the DuPont Chemical Corporation, which is generally acknowledged to be among of the worst corporate polluters on Earth. The state is also home to Dover Air Force Base, which has been identified as a site at which service personnel were exposed to friable asbestos.In 2005, the population of Delaware was just over 840,000, yet reported 249 asbestos cancer deaths.
